Elliott violates protective order; motion filed to dismiss original charges

RED OAK — On top of kidnapping and attempted murder charges from November, William Elliott has been charged with protective order violation from his jail cell at the Montgomery County Law Enforcement Center.

Elliott allegedly called a Red Oak woman from jail, breaking the protective order she had against him. Elliott also had his friends contact the woman stating she better return his dogs and belongings “or else,” according to a Red Oak Police Department report.

Elliott is currently in custody after allegedly kidnapping Shelby Schmitz, 22, of Red Oak, a separate victim from the recent offense, and dousing her in gasoline during November.

The case was scheduled to go before a jury Feb. 18, but prosecuting attorney Bruce Swanson said there is a hearing Monday, Feb. 17 for a motion to dismiss.

He said the state of Iowa is essentially conceding that there is not enough evidence to convict Elliott of kidnapping and attempted murder.
